1. SCOPE
These General Terms and Conditions (GTC) apply to all deliveries from MOFAG AG to consumers.
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

3. OFFER AND CONCLUSION OF CONTRACT
3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. We reserve the right to make technical changes, mistakes, typing and printing errors.
3.2 By clicking the "Send order" button in the last step of the ordering process, you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via e-mail immediately after receiving your order.
3.3 Reduced items and electrical parts cannot be returned or exchanged.
4. CONTRACT TEXT
The text of the contract is stored on our internal systems. You can view the General Terms and Conditions at any time on this page. The order data and the terms and conditions will be sent to you by email. After completing the order, the text of the contract is no longer accessible via the Internet for security reasons.
5. RIGHT OF WITHDRAWAL
Right of withdrawal
Swiss law does not provide for a withdrawal period or other right of return for online trading after the order has been sent.
If a product has a defect or if it lacks a guaranteed property, the buyer must report this to the seller in writing within 7 days.

5A RETURN COSTS WHEN EXERCISING THE RIGHT OF WITHDRAWAL
Returns by the buyer require our prior consent and are at the expense of the customer.
Unused products must be returned within 7 days of the invoice date and may only be in their original packaging (handling fee CHF 50.00). Reduced items, items under CHF 50.-, as well as electrical parts and factory orders cannot be returned.
6. PRICES AND SHIPPING COSTS
6.1 The prices stated on the product pages include statutory VAT and other price components. MOFAG AG can make price changes at any time without prior notice
6.2 The shipping costs depend on the quantity of goods ordered and the shipping method and will be clearly communicated to you before you place your binding order.
You can find an overview on the shipping page. Prices vary for shipping by forwarding agency.
7. DELIVERY
7.1 Deliveries are only made within Switzerland.
7.2 Information on delivery times can be found on the respective product page.
8. PAYMENT
8.1 Payment can be made either by credit card, advance payment, bank transfer or cash within 10 days of the order date at the latest.
If no payment is made by the buyer, a reminder will be sent automatically with a payment term of 10 days.
After this period, the activities amounting to CHF 20.00 will be charged additionally.
8.2 If you select the payment method in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.
8.3 You only have the right to offset if your counterclaims have been legally established by a court or are undisputed or have been recognized by us in writing.
8.4 You can only exercise a right of retention if the claims result from the same contractual relationship.
9. WARRANTY

The sales receipt serves as a guarantee certificate. It must be kept carefully.
In the case of defects for which there is no guarantee, the buyer bears the costs of troubleshooting.
The warranty period begins with the handover, all warranty applications must be submitted in writing.
Conversion or reduction is excluded.
All children's vehicles, fun sport products are sold without warranty.
Batteries / accumulators receive a 6-month guarantee, only if a vehicle guarantee exists at all and with the purchase of new large vehicles.
Vehicles that are not street legal are generally excluded from warranty claims.
The guaranteed location is the headquarters of Mofag AG, Wetzikon
9A. RESERVATION OF TITLE
The goods remain until full payment
